Community Advisory Committee Resolution No. 1-6-04a,
Pursuant to
Suffolk County Code Section 380-5(E), Concerning a
Special Use Exemption Request by the
Suffolk County Community College
for the Use of Pesticides in their Biology Department

WHEREAS, the Suffolk County Community College (SCCC) Biology Department, located on the Selden Campus, uses one greenhouse to house a plant collection for used in labs for educational purposes; and

WHEREAS, greenhouses are an optimal environment for diseases and insect populations, which are often brought in on purchased plants, or caused by high humidity; and

WHEREAS, the SCCC typically controls pests through cultural practices, however, these practices alone are not always effective; and

WHEREAS, the SCCC is committed to incorporating the use of beneficial insects in their pest control procedures; and

WHEREAS, pest infestations can rapidly spread and lead to a loss of a plant resulting in failure of educational efforts and cancellation of certain labs; and

WHEREAS, though the SCCC Biology Department does not typically need to use pesticides, they need the ability to use them on an emergency basis; and

WHEREAS, the SCCC Biology Department has submitted an application for a special use exemption for the use of pesticides on an emergency basis in their greenhouse, attached hereto as Exhibit "A" and incorporated by reference; and

WHEREAS, at a meeting on January 6, 2004, the Community Advisory Committee (CAC) reviewed the above mentioned request for a Special Use Exemption; and

WHEREAS, Local Law 3-2002 was previously reviewed under the State Environmental Quality Review Act ("SEQRA"); and

WHEREAS, by separate resolution, dated January 6, 2004, under the State Environmental Quality Review Act ("SEQRA"), N.Y. Envtl. Conserv. Law Art. 8, the CAC has determined that this action is a Type II action, pursuant to Volume 6 of New York Code of Rules and Regulations ("NYCRR") §§617.5(c)(20) and (27), in that the resolution pertains to routine or continuing agency administration and management, not including new programs or major reordering of priorities that may affect the environment; now

Be it therefore

RESOLVED, that the Suffolk County Community College, Biology Department, Ammerman Campus, will begin to incorporate the use of beneficial insects for pest control in their greenhouse; and, be it further

RESOLVED, that a one year Special Use Exemption, pursuant to Suffolk County Code Section 380-5(E), be granted to the Suffolk County Community College, Biology Department for the use of the following pesticides in their greenhouses at the Selden campus:

K-Neem (a.i. potassium salts and fatty acids)
Marathon II (a.i. imidacloprid)
Floramite (a.i. bifenazate)
Enstar II (a.i. kinoprene)
Conserve (a.i. spinosad)
Cleary's 3336 (a.i. thiophanate methyl); and, be it further

RESOLVED, that the use of these pesticides will occur only after the use of beneficial insects has not been effective to control a particular pest infestation; and, be it further

RESOLVED, that the SCCC will continue to use cultural practices; and, be it further

RESOLVED, that this Resolution shall take effect on January 6, 2004; and, be it further

RESOLVED, that following the one year time period, a renewal request may be submitted.
