Community Advisory Committee Resolution No. 6-25-03a,
Pursuant to
Suffolk County Code Section 380-5(E), Concerning a
Special Use Exemption Request by the
Suffolk County Community College
for the Use of Pesticides in their Horticultural Program

WHEREAS, the Suffolk County Community College (SCCC) Horticultural Program, located on the Riverhead Campus, uses three greenhouses for educational purposes; and

WHEREAS, greenhouses are an optimal environment for diseases and insect populations, which are often brought in on purchased plants; and

WHEREAS, the SCCC typically controls pests through cultural practices and the use of beneficial insects, however, these practices alone are not always effective; and

WHEREAS, pest infestations can rapidly spread and lead to a loss of a crop resulting in detrimental economic and educational effects; and

WHEREAS, though the SCCC Horticultural Program does not typically need to use pesticides, they need the ability to use them on an emergency basis; and

WHEREAS, the SCCC Horticultural Program has submitted an application for a special use exemption for the use of pesticides on an emergency basis in their greenhouses, attached hereto as Exhibit "A" and incorporated by reference; and

WHEREAS, at a meeting on June 5, 2003, the Community Advisory Committee (CAC) reviewed the above mentioned request for a Special Use Exemption; and

WHEREAS, on February 26, 2002 and June 5, 2003 presentations were received by Cindy Megill and Keith Henn regarding the Horticultural Program and potential need for pesticides; and

WHEREAS, Local Law 3-2002 was previously reviewed under the State Environmental Quality Review Act ("SEQRA"); and

WHEREAS, by separate resolution, dated June 25, 2003, under the State Environmental Quality Review Act ("SEQRA"), N.Y. Envtl. Conserv. Law Art. 8, the CAC has determined that this action is a Type II action, pursuant to Volume 6 of New York Code of Rules and Regulations ("NYCRR") §§617.5(c)(20) and (27), in that the resolution pertains to routine or continuing agency administration and management, not including new programs or major reordering of priorities that may affect the environment; now

Be it therefore

RESOLVED, that a one year Special Use Exemption, pursuant to Suffolk County Code Section 380-5(E), be granted to the Suffolk County Community College, Horticultural Program for the use of the following pesticides in their greenhouses at the Riverhead campus:

Marathon II (a.i. imidacloprid)
Floramite (a.i. bifenazate)
Enstar II (a.i. kinoprene)
Conserve (a.i. spinosad)
Subdue Maxx (a.i. mefenoxam); and, be it further

RESOLVED, that the use of these pesticides will occur on an as needed basis when an infestation has occurred; and, be it further

RESOLVED, that the SCCC will continue to use cultural practices and beneficial insects in their pest control efforts and in their educational curriculum; and, be it further

RESOLVED, that following the one year time period, a renewal request may be submitted; and, be it further

RESOLVED, that this Resolution shall take effect on July 1, 2003.
